Basically, a distinction is made between two types of summons:

Juvenile Criminal Law – Summons

1. The Police Summons

When summoned by the police, a juvenile should appear at the police station to learn about the charges. However, a police summons does not necessarily have to be complied with. The police have no coercive powers to do so.

Even at this point, it is advisable to involve a lawyer specializing in juvenile criminal law to accompany the person summoned. Parents and guardians also have the right to appear there.

Once the juvenile has appeared at the police station, they must be informed of the crime they are accused of in accordance with Sections 163a IV and 136 of the Code of Criminal Procedure. This must be done in an age-appropriate manner. Afterwards, the juvenile can decide, either on their own or after consulting with their lawyer, whether they wish to comment on the matter. If the juvenile remains silent on the charge, this cannot be considered an admission of guilt.

If the police have completed their investigation and suspicion of a crime persists, the juvenile criminal proceedings will continue with the court summons.

2. Court Summons

Juvenile criminal law applies to young people between the ages of 14 and 17. Older young people (18–22 years old) are considered adolescents and can be treated under juvenile criminal law or general criminal law.

A young person must appear at a court hearing or a summons for a judicial hearing, which requires them to appear in person. Otherwise, they face being brought before the police. Furthermore, their legal guardians must be informed, as they have the right to attend the hearing in juvenile criminal proceedings. At this point at the latest, the legal guardians should consult a lawyer. Otherwise, the young person must be assigned a public defender.

In a court hearing in juvenile criminal proceedings, the young person can make statements on the case. However, they have the right to remain silent and the opportunity to submit motions for evidence.

In principle, juvenile criminal law is not aimed at punishment, but at education and, above all, at preventing further offenses. To ensure this, judges in juvenile criminal proceedings have three options available after conviction: educational measures, disciplinary measures, and juvenile detention.
