What does “import of narcotics” mean under the Narcotics Act?

The Narcotics Act does not contain a legal definition of the term “import,” but Section 2, Paragraph 2 of the Narcotics Act states: “The import or export of a narcotic is equivalent to any other movement into or out of the scope of this Act.”
Accordingly, the offense of importation is fulfilled as soon as a narcotic is brought from abroad across the German external border into Germany through deliberate human intervention. is brought into the territory of the Federal Republic of Germany.
It is completely irrelevant how this occurs: personally/by hand or through commissioned couriers, by parcel or letter mail. It is also irrelevant for the offense whether the import in question takes place by land, air, or water.

What penalties are there for the illegal import of narcotics?

The quantity of the narcotic is also crucial in the offense of illegal cross-border trafficking in narcotics. The Federal Court of Justice has established the quantity-related limits for narcotics, which are based on the respective active ingredient content.

If the importation is of a small quantity for personal use, the competent authorities may refrain from prosecution. For cannabis products, for example, a gross weight of 51-60 grams is considered a small quantity in Munich and throughout Bavaria.

The illegal importation of a significant quantity of narcotics is classified as a crime – in this case, judges must impose a prison sentence of at least two years under Section 30 of the Narcotics Act.

According to the Narcotics Act, this sentence increases to at least five years’ imprisonment if the defendant acted as a member of a gang or carried a firearm.
